Definitions

Client – a natural or legal person concluding a contract with the Organizer for participation in the Course.

‍Consumer – a natural person concluding a contract with the Organizer for participation in the Course, not directly related to his business activity.

‍Course – an online educational event created by the Organizer.

‍Account – an individual Customer account under which the Course materials are made available.

‍Organizer – HUMI DIGITAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Krotka 33, 42-202 Czestochowa, Polska, VAT number PL9492247885.

‍Portal – an educational panel at https://devforgery.com/portal where the Customer has access to the Account, as well as the website of the selected course where the Customer will find all the necessary information. These regulations apply to the following websites:

Registration – applying for participation in the Course by completing the application form and purchasing the selected package

§ 1. General provisions Within the Portal, the Organizer enables you to Register and access the Course in accordance with the package you choose. In order to use the Portal, it is not necessary to meet specific technical requirements, and it is sufficient to:

  • internet access
  • using a standard web browser
  • having an active e-mail address.

 As part of the Portal, we provide electronic services in the form of:

  • registration for the course,
  • access to educational materials offered as part of the purchased package,
  • participate in online events offered as part of the Course program.

 When using the Portal and taking part in the Course, remember to:

  • not to publish content that is unlawful, contrary to the law or decency,
  • not to provide materials that could adversely affect the operation of the Portal, disrupt or burden its operation,
  • not to publish content that could infringe the rights of others,
  • not to post content that contains harmful software, including viruses or spyware;
  • not to publish content that could cause SPAM to be sent to other users of the Portal.

We make every effort to ensure that the Portal is available 24/7. We will inform you about any planned interruptions in access by e-mail. As part of the Portal, we use organizational and technical measures to ensure the security of your data and published content.

§ 2. Placing an order Conclusion of the contract for participation in the course requires registration in the application form to which you will be redirected after selecting the package. In the form, it is necessary to provide the necessary personal data, and the condition for placing an order is the acceptance of the Regulations. After completing the registration, you will be redirected to the payment gateway, where you will be able to choose the method of payment. After finalizing the payment, you will be redirected to the Portal’s website, where we confirm that you have placed and paid for your order – at this point, the contract for the provision of electronic services is concluded. You will also receive confirmation of the conclusion of the contract and instructions for using the Account and accessing the Course to the e-mail address provided during Registration. As part of the Registration, you are obliged to provide your real personal data. If you provide false data or we have a reasonable doubt as to whether they are true, we reserve the right to suspend the execution of the order and contact you to clarify the situation.

§ 3. Access to the Course With the confirmation of the conclusion of the contract for the provision of electronic services, you will receive access to the Course along with instructions on how to use it. Access to the Course will be possible through a dedicated platform, available at the address indicated, where your individual Account will be created after purchasing the package.

According to the selected package, each day of the Course you will receive an e-mail with information about the availability of recordings and materials that you will be able to use along with information about the elements of the program delivered “live”. Recordings and materials from the Course will be available in your Account for life from the date of their publication. Remember to use the Portal and participate in the Course in accordance with the provisions of the Regulations. If you violate the rules set out herein, we reserve the right to prevent you from continuing to participate in the Course and use the Portal.

§ 4. Delivery and payments The prices of participation packages in the Course are gross prices.

You can pay for participation in the Course using electronic payments offered by Stripe Inc. as part of the Stripe service. By choosing to receive a VAT invoice for the purchase of the package, you agree to receive it in electronic form, to the e-mail address you provided during Registration. After making the payment, you will receive access to the Account along with instructions on how to access the Course to the e-mail address you provided during Registration.

§ 5. Withdrawal from the contract If you have purchased access to the Course as a Consumer, you may withdraw from the contract within 30 days of purchase. Please inform us about it by sending an e-mail to kamil@devforgery.com before this deadline. You will not be entitled to withdraw from the contract if:

  1. we have fully performed the service you have purchased,
  2. you have consented to the provision of purchased content to you immediately after purchase. If you withdraw from the contract, we will be forced to deactivate your access to the Course. We will refund the purchase costs no later than 14 days from the withdrawal from the contract in the same way as you made the payment.

§ 6. Satisfaction guarantee If the content of the Course was not in line with the program and information you received, ie the lectures did not cover the announced topics, you can ask the Organizer for a refund. The time for return is specified on the website of the specific course.

The condition of the return is to describe the reasons for dissatisfaction with the quality of the materials. We will refund the costs of purchasing participation in the Course no later than 14 days from the withdrawal from the contract in the same way as you made the payment.

§ 7. Consideration of complaints and pursuing claims If you find that the services we provide as part of the Course are inconsistent with the offer, the Course program or the provisions of the Regulations, you can submit a complaint by sending an e-mail to kamil@devforgery.com.

Include your data in the complaint and describe what the non-compliance was about. We will consider the complaint within 21 days of its receipt, sending you a response to the e-mail address from which you contacted us. If you do not receive a response from us within 21 days, it means that we have considered your complaint. In accordance with the law, if you have made a purchase as a Consumer, in the event of a dispute between us regarding the services we provide, you can use extrajudicial means of dealing with complaints and pursuing claims in the form of: lodging a complaint via the online ODR platform for resolving disputes between consumers and ODR entrepreneurs, available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=PL, or

Submit an application for dispute resolution to a permanent amicable consumer court, or submit an application for out-of-court dispute resolution to the voivodship inspector of the Trade Inspection.

§ 8. Personal data and cookies The rules for processing and protecting your data and the use of cookies are included in the Privacy Policy, available at: https://devforgery.com/privacy-policy

§ 9. Rights to content The educational materials you receive by taking part in the Course, all texts, graphics and digital content are our property and we are entitled to copyrights to them. Our goal is to share the knowledge contained in these materials with you, but we do not allow you to download, copy and distribute them in an illegal way. § 10. Final provisions As the Organizer, we may introduce changes to the rules set out in the Regulations, provided that such a change:

  • will comply with the law
  • will not infringe the rights you have already acquired (in particular those related to the purchase of participation in the Course)
  • will result from our obligation to adapt the Regulations to changes in the law or decisions of courts or authorities will result from the need to protect you or us as the Organizer against violation of the rules described in the Regulations.

We will inform you about any changes to the Regulations by sending an e-mail to the address you provided us.
